DUI is considered as a criminal act because it violates the law. Whether it is a DUI misdemeanor or a felony, it is still a crime. One must know the consequences that may happen if you berth to driving under the influence offenses.
Classifications of DUI Offenses are as follows:
- 1st DUI Offense
Class A misdemeanor – condemned to 1 year in jail; a fine of up to $2,500; an extra fee of $500 if the BAC is above 0.16; 100 hours of community service if blood alcohol content is above 0.16 and 25 days if a child under 16 is in the car; deferral of license for 1 year.
- 2nd DUI Offense
Class A misdemeanor – punished to 1 year in jail; a fine of up to $2,500; an excess fee of $1,500 if the blood alcohol content is above 0.16; 48 hours of community service if blood alcohol content is over 0.16 and 25 days if a child under 16 is in the car; revocation of license for 5 years.
- 3rd DUI Offense
Class-2 felony – sentenced from 3 to 7 years in jail; a fine of up to $2,500; an additional fee of $2,500 if blood alcohol content is over 0.16; 25 days of community service if a child under 16 is in the car; revocation of license for 10 years.
- 4th DUI Offense
Class-2 felony – punished from 3 to 7 years in jail; a fine up to $25,000; an extra $5,000 if blood alcohol content is over 0.16; 25 days of community service. Driving privileges will be inactive or revoked for life.
- 5th DUI Offense
Class-1 felony – punished from 4 to 15 years, a fine of up to $25,000; an extra $5,000 if blood alcohol content is over 0.16 they; 25 days of community service. Driving privileges will be deferred or revoked for life.
- 6th or more DUI Offense
Class X felony – imprisoned from 6 to 30 years; a fine of up to $25,000; an extra $5000 if BAC is over 0.16; 25 days of community service. Driving privileges will be deferred or revoked for life.
